We take the protection of your personal data very seriously and always process them in accordance with the statutory provisions, in particular with the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (FDPA).

This data protection declaration informs data subjects of the nature, extent and purpose of the recording, processing and use of personal data by the controller.

Access Data of Website Visitors

We compile and store server log files information automatically submitted by your browser such as name of the website called up, file, date and time of the server inquiry, data volume transferred, report on successful access, browser type, browser version, user’s operating system, referrer URL (previously visited page) and IP address. The log files are processed in order to secure the functioning of our website. Moreover, we may use them to optimize our website and to secure the security of our IT systems. These are also the legitimate interests pursued by the controller according to article 6 (1) lit. f GDPR.

We do not submit log files to any third party. Log files are deleted when they are no longer necessary for the purposes for which they were recorded, at the latest after 7 days. The log file information cannot be linked to specific persons. Aggregation of these data with other data pools is not performed. We reserve the right to review the log files of such users, who by reason of certain facts are suspected of illegal behavior when using the website.

Data from E-mail Communication

You can contact us by using the e-mail address provided above. In this case, the personal data which is transmitted by your e-mail will be stored on our e-mail server and, possibly, in electronic data bases. The personal data submitted by your e-mail are processed for the exclusive purpose of communicating with you in order to treat your inquiry. This is also the legitimate interest pursued by the controller according to article 6 (1) lit. f GDPR. In case your inquiry aims at concluding a contract with Phönix-PACS, article 6 (1) lit. b GDPR is also relevant as an additional legal basis. We do not submit personal data from e-mail communication contacts to any third party. Data are deleted when they are no longer necessary for the purposes for which they were recorded.

Customer and Supplier Data

Personal data are possibly required for preparing, concluding and performing contracts with Phönix-PACS. These data are stored in electronic data bases and in our file system (electronic and paper). Personal data of customers and suppliers are processed for the exclusive purpose of “performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”, according to article 6 (1) lit. b GDPR. We do not submit personal data of customers and/or suppliers to any third party. Personal data of customers and suppliers are deleted as soon as the respective legal storage periods are expired.

Applicant Data

Personal data included in your application documents are processed for the exclusive purpose of making a decision regarding the conclusion of an employment contract, according to § 26 (1) FDPA. We do not submit applicant data to any third party. Phönix-PACS GmbH keeps your application documents during the application process. In case of non-employment, all paper application documents will be returned to the applicant and all electronical information about him/her will be erased after completion of the application procedure.

Note about Rights of Data Subjects

Data subjects have the right to request access to their personal data processed by the controller (article 15 GDPR). Data subjects have the right to request the rectification of inaccurate data concerning him or her, and to request the completion of incomplete personal data (article 16 GDPR). Data subjects have the right to request the erasure of their personal data (article 17 GDPR). Data subjects have the right to request restriction of processing of their personal data (article 18 GDPR). Data subjects have the right to request reception of their personal data in a structured, commonly used and machine-readable format (data portability, article 20 GDPR). Data subjects have the right to object at any time to processing their personal data (article 21 GDPR). Data subjects, who consider that the processing of their personal data by Phönix-PACS GmbH infringes the European General Data Protection Regulation, have the right to lodge a complaint with the supervisory authority (article 77 GDPR).
